Japan Caught a Torrent Uploader Without Watching the Swarm. Nobody Will Say How

On 28 July, Kyoto Prefectural Police arrested a 56-year-old man from Sagamihara who is alleged to have spent five years uploading recordings of NHK broadcasts to Nyaa, the largest anime torrent site. The arrest itself is not what makes this notable. It is the sentence the rights-holder group CODA added afterwards: the tool that found him does not watch the BitTorrent swarm at all.

What is established

The suspect is accused of being the first uploader of the NHK drama Midnight Taxi, meaning the person who posted the torrent and seeded the file before anyone else had it. Reports put his output at roughly a thousand NHK recordings over five years. The investigation began in April 2024, so more than two years passed between the start of the work and the arrest.

CODA, the Content Overseas Distribution Association, says it obtained the identifying information using an analytical tool built by the Japan Hacker Association, a partner in CODA's Cross-Border Enforcement Project, which Japan's Ministry of Economy, Trade and Industry has supported since the 2021 fiscal year. Kyoto police then did the identification and the arrest.

What CODA said, and what it refuses to say

Pressed by reporters, CODA gave one substantive sentence: the tool does not analyse activity within the BitTorrent swarm itself, and instead analyses how data moves through torrent sites such as index sites and tracker sites. Asked for anything more concrete, CODA declined, saying disclosure could harm future investigations.

So the honest answer to "how exactly did they find him" is that nobody outside the investigation knows, and the people who do know have decided not to explain. That is worth stating plainly, because the gap is being filled with confident guesses elsewhere. What the statement does do is rule things in and out.

What the statement rules out, and what is left

It rules out the classic method. Ordinarily an investigator joins a swarm, collects the addresses of the peers exchanging pieces, and works back through the internet provider to a subscriber. CODA says that is not what happened. And as TorrentFreak pointed out, analysis at the index and tracker layer does not normally produce a broadband subscriber's address by itself.

What remains are the layers where a person interacts with a website rather than with other peers. The following is our reading of the possibilities, not something CODA has confirmed:

  • The upload itself. Publishing a torrent means making an ordinary web request to an index site, with an account, a session and a time. That is a completely different trail from the swarm.
  • Being first. A first seeder is distinctive by definition: for a short window there is exactly one source. Announcements to a tracker in that window narrow the field far more than a busy swarm ever could.
  • The pattern. A thousand uploads over five years is a behavioural fingerprint - the same naming conventions, the same posting rhythm, the same broadcast source and encoding settings. Patterns identify people even when single events do not.
  • Ordinary legal process. Nothing prevents an analytical tool from producing a lead that is then confirmed with data obtained through the usual requests to services and providers.
Important: Treat any specific technical explanation of this case, including the four possibilities above, as reasoning rather than fact. CODA has not confirmed a mechanism, and confident descriptions circulating now are not based on disclosed information.

What actually changes for people using torrents

Even without the mechanism, the disclosed sentence is useful, because it says where the attention went. Advice about torrent privacy has focused for twenty years on one place: the swarm, where your address is visible to every other peer. That is the layer a VPN covers, and it is the reason the advice exists.

If attribution is happening at the index and tracker layer instead, it lands on things a tunnel does not touch: an account you created, an email you used to register it, the hour you tend to post, the way you name your files, and the fact that you were the only source at a given moment. A VPN changes the address a website sees. It does not change who you are to that website once you have logged in, and it does not make a five-year behavioural pattern less distinctive.

This is also part of a wider shift in enforcement from blocking sites to reaching individuals, visible when the MPA pushed for US site blocking after a record raid failed to move the numbers and when France legalised real-time blocking of pirate sports streams.

Conclusion

Conclusion: The interesting part of this case is not that someone was arrested, it is that the method was announced as new and then withheld. Until CODA explains what its tool observes, the only safe reading is the narrow one: swarm-level anonymity was not what failed here, so swarm-level protection is not what would have prevented it. The layers above it, accounts, timing and long-running habits, are where this case actually points.
